ICAO – 몬트리올협약 책임한도 개정 발효 통지(2024.10.16)

ICAO가 몬트리올협약 제24조 제2항에 따른 책임한도 수정의 발효를 모든 당사국에 알린 2024년 10월 16일자 통지다. 당사국 과반수의 반대가 없었고, 수정 한도는 2024년 12월 28일부터 모든 당사국에 효력을 갖는다고 명시한다. 화물의 파괴·분실·손상·지연 한도는 1킬로그램당 26 SDR이다. 통지 표의 최초 17 SDR 및 2019년 22 SDR과 수정 금액을 구별해야 한다.

Subject: Revision of limits of liability under the
Montreal Convention of 1999 – Notification of
effective date of revised limits

Action required: a) to take note that the revised
limits of liability shall become effective as of
28 December 2024 for all States Parties to the
Montreal Convention; and b) to adjust as
necessary implementing legislation to give full
effect to the revised liability limits

Sir/Madam,

              I have the honour to refer to State letter LE 3/38.1-IND/24/4, dated 28 June 2024, by which

ICAO had communicated to States Parties the results of the review of the limits of liability pursuant to
Article 24, paragraph 2, of the Convention for the Unification of Certain Rules for International Carriage
by Air, done at Montreal on 28 May 1999 (Doc 9740).

               As set out in paragraph 8 of the above-mentioned State letter, States Parties were advised

that the limits of liability established under the Montreal Convention would need to be revised as follows:

              States Parties were notified that, in accordance with the tacit approval mechanism spelled

out in paragraph 2 of Article 24 of the Montreal Convention, the said revisions shall become effective for
all States Parties six months following the notification, unless within three months after the notification, a
majority of States Parties registered their disapproval with ICAO. No such majority disapproval occurred.

             States Parties are accordingly invited to make provisions as necessary in accordance with

their domestic legal requirements, to give full effect as of 28 December 2024 to the revised limits.
